What is Trademark Registration?

Trademark Registration is a legal process under the Trade Marks Act, 1999 that allows businesses to protect their unique symbols, names, taglines, or designs. Once registered, a trademark grants the owner exclusive rights to use it for commercial purposes and provides legal recourse against unauthorized use by others.

Key examples of trademarks include:

  • Logos: Apple’s bitten apple logo.
  • Brand Names: Pepsi, Amazon, TATA.
  • Taglines: Amul’s “The Taste of India.”
  • Shapes/Packaging: The Coca-Cola bottle design.
  • Sounds: Intel’s chime sound.

 

The Process of Trademark Registration

Step 1: Conduct a Trademark Search

A trademark search is conducted to check whether your desired trademark is already in use or registered. This step minimizes the risk of objections and ensures uniqueness.

Step 2: Filing the Trademark Application

The application (Form TM-A) must be filed with the following details:

  • The applicant’s name and address.
  • A clear representation of the trademark.
  • A list of goods or services for which the trademark will be used (as per NICE classification).

Step 3: Examination by the Registrar

The Trademark Registrar reviews the application to ensure it complies with legal requirements. If the Registrar identifies any discrepancies, an Examination Report is issued with suggestions or objections.

Step 4: Publication in the Trademark Journal

Once approved, the trademark is published in the Trademark Journal, allowing the public or other businesses to raise objections within 4 months.

Step 5: Addressing Objections or Oppositions

If an objection is raised, the applicant must respond within the stipulated time. Similarly, if opposition occurs during the publication period, a hearing may be scheduled to resolve disputes.

Step 6: Issuance of Trademark Registration Certificate

If no opposition is received or objections are resolved, the Registrar issues the Trademark Registration Certificate, granting the applicant exclusive rights to the trademark.

 

Documents Required for Trademark Registration

To complete the trademark registration process, the following documents are required:

For Individuals/Proprietors

  1. Aadhaar Card, PAN Card, or Passport.
  2. Trademark logo (if applicable).
  3. Signed Form TM-48 (Power of Attorney).

For Companies or Partnerships

  1. Certificate of Incorporation or Partnership Deed.
  2. GST Registration Certificate (if available).
  3. Authorization letter for filing the trademark application.

Additional Information

  • A brief description of the goods or services associated with the trademark.
  • MSME or Startup Certificate (if applicable) for reduced government fees.

 

Time Period for Trademark Registration

Trademark Registration is a detailed process and takes approximately 12–18 months to complete, depending on objections or oppositions.

  • Immediate Use of the ™ Symbol: You can use the ™ symbol as soon as you file the application.
  • Use of the ® Symbol: This symbol can only be used after the trademark is officially registered.
